Terms and Conditions
1. The Service
QejaCrib provides tools for tenants and prospective tenants to search for housing, save listings, submit applications, manage active leases, pay rent and utilities where your landlord has enabled payments, upload payment proofs, submit maintenance requests, register visitors, communicate with landlords, and receive notifications.
Landlords and property managers use a separate QejaCrib landlord platform. QejaCrib is a technology platform only. We are not your landlord, agent, insurer, or escrow holder unless we expressly agree otherwise in writing.
2. Eligibility & your account
- You must be at least 18 years old and able to enter a binding contract.
- You must provide accurate, current information and keep it updated.
- You are responsible for safeguarding your login credentials and for all activity under your account.
- We may suspend or terminate access if you violate these Terms, pose a security risk, or if required by law.
3. Tenancy, deposits & payments
Your lease, rent amount, deposit requirements, and house rules are set by your landlord, not by QejaCrib. Payment options depend on what your landlord configures for each property (for example manual M-Pesa paybill or till instructions, or automated M-Pesa STK through Paystack where available).
- Successful payment in the app does not by itself change your legal obligations under your lease; keep your own records and confirmations.
- Manual payments may require you to pay outside the app and upload proof; your landlord verifies receipt.
- Automated payments may require you to approve an M-Pesa prompt on your phone; processing depends on banks, Paystack, and Safaricom.
- Security deposits are arranged between you and your landlord. QejaCrib does not hold tenant security deposits unless explicitly stated in writing.
- Disputes about rent, refunds, deposits, or lease termination must be resolved with your landlord.
- QejaCrib is not a party to your lease unless explicitly stated in writing by QejaCrib and your landlord.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent, or harmful purpose.
- Harass, threaten, or impersonate another person.
- Upload false, misleading, or infringing content.
- Attempt to access accounts, data, or systems you are not authorised to use.
- Interfere with or reverse-engineer the Service except where the law permits.
- Scrape, resell, or commercially exploit the Service without our written consent.
5. Your content
You retain ownership of content you submit (such as maintenance photos, messages, and reviews). You grant QejaCrib a non-exclusive, worldwide licence to host, store, display, and transmit that content solely to operate the Service and share it with your landlord and our service providers as needed.
6. User-generated content & safety
QejaCrib has zero tolerance for objectionable content or abusive users. Messages, reviews, and other user content must not include harassment, hate speech, threats, sexual content involving minors, spam, scams, or illegal material.
- Use in-app Report to flag objectionable messages or reviews.
- Use Block user to hide a user from your feed immediately; blocking also notifies QejaCrib to review the reported content.
- We aim to review reports within 24 hours and may remove content or suspend accounts that violate these Terms.
- Contact us via our support page if you need urgent help.
7. Third-party services
The Service integrates with third parties (including authentication providers, payment processors, and mapping services). Your use of those features may be subject to their terms. We are not responsible for third-party outages, fees, or actions outside our reasonable control.
8. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, QejaCrib disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted operation, listing accuracy, payment confirmation times, or that any property will remain available.
9. Limitation of liability
To the maximum extent permitted by law, QejaCrib and its affiliates, directors, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or tenancy opportunities arising from your use of the Service.
Our total liability for any claim relating to the Service shall not exceed the greater of (a) fees you paid to QejaCrib for the Service in the twelve (12) months before the claim, or (b) KES 5,000 if you paid no fees. Some jurisdictions do not allow certain limits; in those cases our liability is limited to the maximum permitted by law.
10. Privacy
Our Privacy Policy explains how we collect, use, and protect personal data. By using the Service, you acknowledge that you have read the Privacy Policy.
11. Changes & termination
We may modify these Terms or discontinue features. We will post updated Terms in the app and on this page with a new effective date where practicable. You may stop using the Service at any time. We may terminate or suspend access if you breach these Terms or where required for security or legal compliance.
12. Governing law
These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law rules. Courts in Kenya shall have exclusive jurisdiction, subject to mandatory consumer protections that may apply to you.
